課程概述

全球化、貿易、投資與公共衛生之法律關係，近年來已成為國際經濟法領域中極為重要的新興課題。肥胖、食品安全、藥品、菸品與疾病控制議題均與貿易自由化或投資保護產生密切的關聯。近年來區域貿易協定(例如Trans-Pacific Partnership Agreement(TPP)或其他新興協定)多設有影響藥品貿易或投資之規範，對公共衛生與藥品取得(access to medicine)有其重要影響。本學期將以此議題為討論核心。
以下略述討論內容:

7.Data Exclusivity and Patent Linkage and its Implications for public health and access to medicine
8.Enforcement of Intellectual Property Rights and its Implications for public health and access to medicine
9.Patent Protection under Investment treaties
10.Pharmaceutical-Related IP Investment Rights in the TPP
11.Investor-State dispute settlement in the TPP
 

課程目標
 本課程期望藉由課堂討論，增進同學對國際經貿法與國際衛生法之認識與瞭解。 
課程要求
 . 由同學選擇總論部份之相關主題，進行課堂報告。
. 參與課堂討論。
. 選擇特定主題，撰寫短文（short paper），先進行課堂報告。經課堂討論後，並以修訂版本作為期末書面報告。
. 評量方式：課堂參與佔40%、課堂報告佔40%、期末報告佔20%。
本課程必要時，將視實際修課人數與參與討論情形另外調整安排進度或教材。
